Foreign Marriage Documentation

 Act No. 103 of 1976 amending certain provisions of Act No. 68 of 1947 on documentation set out a number of conditions and papers required of foreigners wishing to marry Egyptians, which may only be documented in accordance with the law. "The marriage of Egyptians may not be documented as alienated if it is apparent to the notary that the contractors' eligibility, consent, qualifications or authorities do not exist or that the conditions do not exist, or if the author whose documentation is requested is manifestly invalid, where the law requires the notary to ". Refuses to authenticate and notify those concerned about the refusal of a recommended letter explaining the reasons for the refusal:

The law stipulates that, prior to the procedure for documenting the marriage of foreigners, the notary must ensure that the required conditions and papers are in place. "

1. The presence of the child in person when the contract is documented "Both husband and wife

2.Family Approval (if applicable) Evidence of family consent or relevant authorization may be required.

 3.Photographs and Medical Certificates Submission of five recent personal photographs for each party, along with medical certificates issued by a government hospital.   

4.Age Difference The age difference between the spouses must not exceed 25 years. If it does, additional legal requirements may apply. 

5.Financial Requirement (if applicable) If the age difference exceeds 25 years, the foreign party may be required to provide an investment certificate issued by the National Bank of Egypt in the amount of EGP 50,000 in the name of the Egyptian spouse.

6- The alien's residence in Egypt must be on offer other than tourism.

7.Minimum Age Requirement Both parties must be at least 21 years old.

8.No-Objection Certificates The foreign party must provide two certificates issued by the competent authority or consulate of their country: oOne confirming no objection to the marriage oOne including personal details such as date of birth, nationality, religion, occupation, country of residence, marital status, previous marriages, number of children, financial status, and sources of income Both certificates must be officially authenticated by the relevant Egyptian authorities.

9.Proof of Birth Each party must provide a birth certificate. If unavailable, the foreign party may submit an equivalent official document, while the Egyptian party must provide an official birth certificate extract.

10.Documentation Procedures The marriage contract must be finalized at the Real Estate Registry Office of the Ministry of Justice.

11.Authentication The marriage contract must be authenticated by the Ministry of Foreign Affairs.

 Important Note: Some embassies may impose strict requirements or refuse to issue a No-Objection Certificate. In such cases, a practical legal solution commonly used is the notarization of a customary marriage contract, followed by legal procedures to establish and formally prove the marriage.
