Foreign Marriage Documentation

We provide professional services for the documentation of marriage contracts involving foreign nationals through a specialized and highly experienced team with extensive knowledge in dealing with the Ministry of Justice and relevant Egyptian authorities.
Under Law No. 103 of 1976, which amended certain provisions of Law No. 68 of 1947 regarding documentation, specific legal requirements and documents must be fulfilled for marriages between Egyptians and foreigners. Such contracts can only be officially documented upon full compliance with all legal conditions. The law obligates the notary to refuse documentation if any requirement is unmet and to notify the concerned parties via registered correspondence, stating the reasons for refusal.
Requirements for Documenting Foreign Marriage Contracts Before proceeding with documentation, the notary must verify the availability of the following conditions and documents:
1.Personal Presence Both the husband and wife must be present in person during the documentation process.
2.Family Approval (if applicable) Evidence of family consent or relevant authorization may be required.
3.Photographs and Medical Certificates Submission of five recent personal photographs for each party, along with medical certificates issued by a government hospital.
4.Age Difference The age difference between the spouses must not exceed 25 years. If it does, additional legal requirements may apply.
5.Financial Requirement (if applicable) If the age difference exceeds 25 years, the foreign party may be required to provide an investment certificate issued by the National Bank of Egypt in the amount of EGP 50,000 in the name of the Egyptian spouse.
6.Residency Status The foreign party must hold a valid residency permit in Egypt for purposes other than tourism.
7.Minimum Age Requirement Both parties must be at least 21 years old.
8.No-Objection Certificates The foreign party must provide two certificates issued by the competent authority or consulate of their country: oOne confirming no objection to the marriage oOne including personal details such as date of birth, nationality, religion, occupation, country of residence, marital status, previous marriages, number of children, financial status, and sources of income Both certificates must be officially authenticated by the relevant Egyptian authorities.
9.Proof of Birth Each party must provide a birth certificate. If unavailable, the foreign party may submit an equivalent official document, while the Egyptian party must provide an official birth certificate extract.
10.Documentation Procedures The marriage contract must be finalized at the Real Estate Registry Office of the Ministry of Justice.
11.Authentication The marriage contract must be authenticated by the Ministry of Foreign Affairs.
Important Note: Some embassies may impose strict requirements or refuse to issue a No-Objection Certificate. In such cases, a practical legal solution commonly used is the notarization of a customary marriage contract, followed by legal procedures to establish and formally prove the marriage.

First: Foreigners’ Residency Services
Foreign residency in Egypt is governed by various categories, each with specific conditions and durations. Our services include advising on eligibility, preparing documentation, and managing all application procedures.
1. Special Residency (10 Years – Renewable)
Granted to foreigners born in Egypt before 26 May 1952 or those who resided in Egypt for 20 years prior to that date.
2. Ordinary Residency (5 Years – Renewable)
Available to foreigners who resided continuously in Egypt for 15 years prior to 26 May 1952, as well as their minor children. This category includes provisions for travel permissions and regulated absence periods.
3. Five-Year Temporary Residency
Granted to specific categories, including:
* Foreign investors and their families
* Individuals of Egyptian origin who have lost their nationality
* Children of Egyptian mothers
* Elderly residents with long-term presence and financial means
* Beneficiaries under international agreements
* Spouses and dependents of eligible residents
Wives and widows of Egyptians Wives of foreigners licensed in ordinary residence Wives and children of foreigners authorized in five-year residence in previous cases
4. Three-Year Residency (Renewable)
Applicable to categories such as:
* Foreign spouses of Egyptian nationals
* Employees in government, public, and private sectors
* Certain Palestinian residents and holders of travel documents
* Registered refugees and special humanitarian cases
* Dependents of eligible residents
5-Temporary Residency (Non-Touristic)
A one-year residence permit may be granted for non-touristic purposes to the following categories:
-Employees in government, public authorities, public sector entities, local administration units, or business sector companies, as well as their spouses and children
-Employees in the private and investment sectors, subject to obtaining a work permit from the Ministry of Manpower and Employment, including their spouses and children
-Students enrolled in universities, institutes, and schools based on official enrollment certificates
-Parents of students studying in Egypt
-Foreign nationals coming to Egypt for voluntary work at their own expense
-Spouses of Egyptian women (granted residency for one year under the sponsorship of the Egyptian wife)
-Children of Egyptian mothers who have reached adulthood, provided they hold a valid work permit
-Parents of investors holding five-year residency, under sponsorship of the investor and upon a recommendation from the General Authority for Investment
-Divorced Egyptian women who are custodians of Egyptian children
-Minor children and spouses of foreign nationals holding temporary residency in a personal capacity
-Property owners with registered real estate contracts in the Real Estate Registry, provided the property value is not less than USD 50,000, with payment transferred through an Egyptian bank
-Relatives of Egyptian nationals up to the second degree, over 50 years old, who have resided in Egypt continuously for five years and have sufficient means of support or are sponsored by a relative up to the fourth degree
6. Tourist Residency
A tourist residency permit may be issued for a maximum period of one year, renewable, for purposes such as tourism, visitation, or medical treatment.
-Renewal applications must be submitted within 15 days after the expiry of the residence permit through the competent authority or its branches
-In case of renewal, the applicant must apply to the relevant authority or one of its regional offices
Second: Work Permits for Foreigners:
Applications for employing foreign workers are submitted to the Ministry of Manpower and require the following:
-The foreign worker must be located outside Egypt at the time of application
-A formal power of attorney authorizing the representative to complete the procedures
Required Documents:
-Commercial registration of the establishment
-Tax card
-Articles of incorporation
-Company newspaper (official publication)
-A certificate of expertise for the foreign employee (not less than three years), certified, legalized, and translated by an official office, matching the required job title
-Employment contract signed and legalized in the foreign worker’s home country and authenticated by the Egyptian Consulate
-Appointment of two Egyptian assistants for the foreign employee, with copies of their qualifications
-Social insurance form (Form 2) stamped by the Social Insurance Authority
-Three copies of the foreign worker’s passport
-For workers from East Asia (India, Pakistan, Philippines, Bangladesh, etc.), additional legalization requirements apply
Third: Acquisition of Egyptian Nationality
Acquisition of nationality refers to obtaining citizenship after birth, known as acquired nationality, as opposed to original nationality, which is acquired at birth. According to Law No. 26 of 1975, as amended by Law No. 154 of 2004, Egyptian nationality may be acquired through the following methods:
1. By Birth An individual is considered Egyptian if: Born to an Egyptian father or an Egyptian mother Born in Egypt to unknown parents (a foundling is presumed to be born in Egypt unless proven otherwise) If a person holds dual nationality, they may declare their desire to renounce Egyptian nationality to the Minister of Interior. Minors may be represented by their legal guardian. A person who has lost Egyptian nationality may apply to regain it within one year of reaching adulthood, subject to approval by the Minister of Interior. Children born to an Egyptian mother and a non-Egyptian father before the implementation of the law may declare their desire to obtain Egyptian nationality, and the Minister shall decide accordingly within a specified period.
2. By Marriage According to the law: A foreign woman married to an Egyptian man does not automatically acquire Egyptian nationality She may apply for nationality by declaring her desire to the Minister of Interior The marriage must continue for at least two years following the declaration, unless terminated due to the husband’s death The Minister may, by reasoned decision, deny the acquisition of nationality within the two-year period If nationality is acquired, it is not lost upon termination of the marriage unless the individual regains foreign nationality or acquires another nationality through marriage.
3. By Naturalization The law provides several cases for acquiring Egyptian nationality through naturalization, including: Naturalization based on birth in Egypt and Egyptian maternal origin Naturalization based on continuous legal residence in Egypt for five years Naturalization based on dual birth in Egypt and affiliation with an Arab or Islamic country Naturalization based on birth and legal residence in Egypt upon reaching adulthood Naturalization after ten years of continuous residence in Egypt Special cases granted by the discretion of the President of the Republic under the law
